On February 23, 2015, the Vachon Law Firm filed a lawsuit against the popular Costa Mesa, California new and used car dealership Orange Coast Chrysler Jeep Dodge Costa Mesa. The lawsuit is titled Walthers et al. v. Orange Coast Auto Group, LLC, et al. (Case No. 30-2015-00773063) involves the sale of an allegedly accident-damaged used vehicle, and was filed in Santa Ana, California, in the Orange County Superior Court.
Allegations in Complaint Against Orange Coast Chrysler Jeep Dodge Costa Mesa
The Plaintiffs in the Walthers v. Orange Coast Auto Group, LLC lawsuit are a San Jacinto couple who visited Orange Coast Chrysler Jeep Dodge Costa Mesa in December 2014. According to the lawsuit’s complaint, Orange Coast Chrysler Jeep Dodge Costa Mesa showed the Plaintiffs a 2014 Jeep Compass and told them that it was a “certified” used automobile. The complaint also alleges that the Plaintiffs asked if the Jeep Compass had ever been in any accidents, and that Orange Coast Chrysler Jeep Dodge Costa Mesa told them that the Jeep Compass had been rigorously inspected, its vehicle history had been checked, and it was in excellent mechanical condition.
The Plaintiffs purchased the Jeep Compass, and allege in their complaint that shortly after they bought it they discovered that it had actually previously been in a “severe collision, which materially decreases the Jeep Compass’s safety, utility, performance, and value.”
Based on these allegations, the complaint asserts causes of action against Orange Coast Chrysler Jeep Dodge Costa Mesa for breach of warranty (under the California lemon law statute), fraud, unfair competition, and violation of the Consumers Legal Remedies Act.
