On April 14, 2015, the Vachon Law Firm filed a lawsuit in the Sacramento County Superior Court against Elk Grove Dodge Chrysler Jeep, the popular Sacramento County Chrysler dealer. The lawsuit is titled Mojica, et al. v. Elk Grove Auto Group, Inc., et al. (Sacramento County Superior Court Case No. 34-2015-00177903).
Allegations in the Lawsuit Against Elk Grove Dodge Chrysler Jeep
The complaint in the Elk Grove Dodge Chrysler Jeep lawsuit alleges that the plaintiffs, a Wilton, California couple, visited Elk Grove Dodge Chrysler Jeep in July 2013, and that while they were there they looked at and purchased a 2013 Dodge Ram. According to the complaint, the plaintiffs were not able to make an immediate down payment towards the Dodge Ram, and as a result the plaintiffs and Elk Grove Dodge Chrysler Jeep agreed that the plaintiffs would come back within the next couple of days to make an agreed-upon down payment. According to the complaint, the effect of this agreement was that plaintiffs had agreed to make a “deferred down payment” towards their purchase of the Dodge Ram.
The lawsuit’s complaint goes on to allege that when Elk Grove Dodge Chrysler Jeep prepared the purchase contract for the Dodge Ram, it falsely stated therein that the plaintiffs were making an immediate down payment and had not agreed to make any deferred down payments. Specifically, the complaint asserts that “Elk Grove Dodge Chrysler Jeep falsified the down payment and the deferred down payment amounts in the purchase contract in order to obtain Plaintiffs’ signatures on a contract before they changed their mind, and to trick a lender into financing a vehicle purchase that it otherwise would not finance.” Based on these allegations, the complaint asserts causes of action under California Automobile Sales Finance Act and Consumers Legal Remedies Act for failing to disclose a deferred down payment.
