Badge For Class Action Against Toyota Financial Services

The Vachon Law Firm has filed a class action lawsuit against Toyota Motor Credit Corporation (which does business under the fictitious names “Toyota Financial Services” and “Lexus Financial Services“). The complaint was filed in the Los Angeles County Superior Court on June 8, 2015. It alleges that Toyota/Lexus Financial Services failed to comply with California’s laws governing the repossession of leased automobiles, that it is not entitled to collect lease deficiency balances from any of the class members, and that it is obligated to refund any deficiency balance amounts already collected.

To be potentially covered by the class action, you must meet the following requirements:

  1. you leased a Toyota or Lexus brand automobile from a car dealership located in California;
  2. you made your lease payments to Toyota Financial Services or Lexus Financial Services;
  3. your vehicle was repossessed or you terminated your lease early;
  4. on or after June 8, 2011, Toyota Financial Services or Lexus Financial Services sent you a notice that it intended to sell your repossessed vehicle (click here for a picture of a sample post-repossession notice); and
  5. after your vehicle was sold Toyota Financial Services or Lexus Financial Services sent you a final account statement itemizing the amount that you supposedly owe under your lease contract (click here to see a sample post-repossession account statement).
