On September 30, 2013, the Vachon Law Firm filed a lawsuit against EZ Auto Solutions (a popular Sacramento, California used car dealership) alleging causes of action for fraud, violation of the California lemon law, and failing to comply with California’s consumer protection laws. The dispute arises out of the sale of an accident-damaged used automobile. The lawsuit is titled Tickner, et al. v. EZ Auto Solutions, Inc., et al. (Sacramento County Superior Court Case No. 34-2013-00151869).
The Complaint Against EZ Auto Solutions
The Plaintiffs in the Tickner v. EZ Auto Solutions lawsuit are a Sacramento, California couple who purchased a used 2008 Toyota Tacoma from EZ Auto Solutions in July 2012. The Plaintiffs allege in the lawsuit’s Complaint that prior to purchasing the Toyota Tacoma EZ Auto Solutions told them that the truck “had been thoroughly inspected, had not been in any prior accidents, and was in excellent mechanical condition.” However, the Plaintiffs further allege that after they purchased the Toyota Tacoma they discovered that it had previously been in a serious accident in which it sustained frame damage. Indeed, the Plaintiffs allege that the damage is so severe that it is now impossible to properly align the truck’s wheels.
Based on these allegations, the Complaint alleges that EZ Auto Solutions breached the implied warranty of merchantability imposed by California’s lemon law statute, committed common law fraud, violated both the Consumers Legal Remedies Act and the Unfair Competition Law statute. Please note: the Sacramento County Superior Court has not yet ruled on whether the Complaint’s allegations are true or whether EZ Auto Solutions violated any laws. EZ Auto Solutions is expected to deny all of the Complaint’s allegations when it answers in the case.
